SO! Lots of you read my post about "REALLY??!?! with your host Christianne Gordon"...I have an update!
We had a Round 2 go round on Wednesday...here's the low-down...
The Highest and Best offer was required to be submitted by 10am on Wednesday. The request for Highest and Best was given to the listing agent by the bank Monday afternoon, but it was not transmitted to me until Tuesday morning. I had to call him again at his home to find out "What's the status?".
He was perturbed with me but I was not going to give up on this deal. My clients WANTED that house and I was going to do everything I could to help them, in spite of the listing agent! So he sent me the Highest and Best request, and asked for a confirmation, which I promptly replied to. He sent it again 2 hours later, asking for another confirmation. Again, I replied and told him I had it. Then he faxed it to me around 2pm. He asked for a reply. I called (but we know by now he never answers) so I left a message saying "Thank you, I have it".
In the meantime, I had gotten with my clients and we wrote a Highest and Best addendum. I spoke with my broker and asked that he send it to the listing agent's broker, so there's no funny business and my offer doesn't get "shopped"...
Well, my broker tried calling the listing agent's broker, but we could never get through on Tuesday evening...
Wednesday morning at 8am I get an email from the listing agent stating he never got a confirmation from me that I received the Highest and Best request so he's sending it again. At this point, I called his house. (I figured out he's always home until about 9:30am!) I told him we had a Highest and Best addendum and that my broker would be providing it to his broker since we seem to be having communication difficulties.

He stated that if I didn't send it via his required method, he couldn't be held responsible for receipt. REALLY??!?! So does that mean sending a document to the main fax line at his office, where I can call a receptionist to verify receipt doesn't constitute receipt? News to me...
I started faxing it to all available fax numbers I had for this guy at 9:30am. I got fax confirmations and then kept calling to verify receipt. No one was available.
In the meantime, my broker spoke with his broker. The listing agent's broker said he was unaware of any arbitrary deadline that Highest and Best's were due by...REALLY??!?! So does that mean the 10am deadline was only put on me? Hmmm...
The happy ending is...at 9:48pm last night, I received an email from the listing agent, with a copy to his broker, stating my client's offer had been accepted pending their signatures of the bank's addendum! REALLY??!? Could it be true? Oh I was so happy!
I didn't know banks worked at 9:48pm but who cares! I emailed my clients and gave them the good news and I am anxiously awaiting the bank addendum...and we are both copying our respective brokers on all correspondence, which he has requested all be in writing...
That's fine with me. In the end, my clients got the house of their dreams...REALLY!
